Rafaheya – Terms & Conditions
These Terms and Conditions govern all bookings with Rafaheya (hereinafter, “the Company,” “we,” or “us”). By confirming a reservation, the Purchaser (hereinafter, “you” or “the Guest”) acknowledges and agrees to be bound by the following provisions.
1. Responsibility and Liability
1.1. Rafaheya acts solely as the operator of the dahabeya vessel. In providing accommodations, excursions, transfers, meals, activities, or other services, the Company may utilize independent suppliers and contractors (airlines, ground transport, hotels, restaurants, guides, tour operators, etc.). Each provider is solely responsible for its own acts or omissions and is not an agent, employee, or representative of Rafaheya.
1.2. The Company shall not be liable for:
Loss, damage, delay, inconvenience, injury, illness, or death arising from acts or omissions of third parties.
Loss, theft, or damage to luggage, valuables, or personal effects, whether on board, in cabins, during excursions, or in transit.
Force majeure events or circumstances beyond its control.
1.3. Guests are strongly advised not to leave valuables unattended. Safety deposit boxes may be provided, subject to availability.
2. Health, Safety & Insurance
2.1. Guests are responsible for ensuring that they are medically and physically fit to undertake the voyage and associated activities. The Company shall not be responsible for any medical costs incurred.
2.2. A qualified physician is not carried on board. Medical services may be arranged ashore at the Guest’s sole expense.
2.3. The Company reserves the right to refuse embarkation or disembark any Guest who, in its sole judgment, may endanger the health, safety, or comfort of others.
2.4. Guests are strongly advised to obtain comprehensive travel insurance covering medical expenses, trip interruption, loss of property, accident, personal liability, and cancellation.
3. Prices & Inclusions
3.1. Unless otherwise stated in writing, prices are quoted in United States Dollars (USD) and include taxes and applicable service charges.
3.2. Packages are typically sold on a full board basis including meals and selected non-alcoholic beverages.
3.3. Excluded services (non-exhaustive): alcoholic beverages, premium soft drinks, spa treatments, laundry, room service, boutique purchases, gratuities, medical services, and personal expenses.
3.4. Prices are subject to change without notice until full payment has been received.
4. Payment Policy
4.1. Unless otherwise stated in writing, 100% payment is due at the time of booking.
4.2. Payments are non-refundable except as expressly provided in Section 5 (Cancellation).
4.3. Payment must be made in the currency, method, and timeline specified in the booking confirmation.
5. Cancellation & No-Show Policy
5.1. Cancellations must be submitted in writing and acknowledged by the Company.
5.2. Standard cancellation penalties (unless otherwise stated in your confirmation):
Up to 60 days prior to embarkation: Full refund of amounts paid, or one-time change of dates at no additional cost (subject to availability and seasonal rate differences).
59–31 days prior to embarkation: 50% of the total booking value is non-refundable.
30 days or less prior to embarkation: 100% of the total booking value is non-refundable.
No-show: 100% of the total booking value is charged
5.3. Charter bookings and peak season departures may carry stricter conditions. Refer to your booking confirmation.
5.4. The Company reserves the right to cancel a voyage at its discretion for reasons of safety, force majeure, or operational necessity. In such case, the Company may, but is not obligated to, offer an alternative sailing date, credit, or refund, without further liability.
6. Force Majeure
Neither party shall be liable for failure or delay caused by circumstances beyond its reasonable control, including but not limited to: war, terrorism, riots, strikes, epidemics, governmental restrictions, adverse weather, navigational hazards, low/high water levels, or closure of locks/bridges.
7. Children Policy
7.1. Children of all ages are welcome on board.
7.2. Accommodation & pricing:
0–5.99 years: Complimentary stay when sharing existing bedding with parents. Excursions are offered free of charge. Complimentary meals may not be included unless explicitly stated.
6–11.99 years: 50% reduction on the applicable adult rate when sharing a cabin with parents. Excursions, where available, are charged at 50% of the adult rate.
12 years and above: Considered adults and subject to the full fare.
7.3. Extra bedding: Rollaway or extra beds may be provided, subject to availability, at a supplement of USD 10 per day.
7.4. Facilities restrictions: Access to spa and gym facilities is strictly limited to adults. Children are not permitted to use these facilities under any circumstances.
8. Programs & Sailing Schedule
8.1. Published itineraries are subject to change without notice due to: Nile water levels, adverse weather, port authorities, bridge or lock closures, or other navigational or safety requirements.
8.2. The Company reserves the right to substitute vessels, ports, excursions, or services if necessary for operational or safety reasons, without liability to the Guest.
9. Conduct Onboard
9.1. Guests must comply with all onboard rules and instructions issued by the captain or crew.
9.2. The Company reserves the right to disembark, at the Guest’s expense and without refund, any person whose conduct is deemed unsafe, disruptive, or prejudicial to the safety, comfort, or enjoyment of others.
10. Enforceability & Governing Law
10.1. These Terms and Conditions are legally binding.
10.2. Any dispute shall be governed exclusively by the laws of the Arab Republic of Egypt.
10.3. Courts of Cairo, Egypt, shall have exclusive jurisdiction.
11. Electronic Communications
Electronic communications are inherently non-confidential. The Company shall not be liable for unauthorized interception or misuse of transmitted information.
